Welcome to Buytopia, an online marketplace that connects buyers with a wide range of products and sellers. These Terms of Service ('Terms') govern your access to and use of Buytopia's services, including our website and mobile applications (collectively, the 'Platform').

By accessing or using our Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Platform.

We may modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on this page with a new effective date. Your continued use of the Platform after such modifications constitutes your acceptance of the revised Terms.

Buytopia acts only as a marketplace connecting buyers and sellers.Buytopia does not own or sell products. Sellers are responsible for all applicable taxes, duties and compliance with local laws.

You must be at least 18 years old to use our Platform. By using the Platform, you represent and warrant that you meet this requirement.

To access certain features of our Platform, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to close your account at any time for any or no reason, including if we determine, in our sole discretion, that you have violated these Terms.

Buytopia provides a platform where buyers can discover and purchase products from various sellers. We do not own, sell, or distribute the products offered on our Platform, except in specific cases where clearly indicated.

You agree to use our Platform only for lawful purposes and in accordance with these Terms. You agree not to use our Platform:

• In any way that violates any applicable federal, state, local, or international law or regulation

• To transmit any material that is defamatory, obscene, invasive of another's privacy, or offensive

• To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Platform

• To impersonate or attempt to impersonate Buytopia, a Buytopia employee, another user, or any other person or entity

• To engage in any activity that could disable, overburden, damage, or impair the Platform

When you make a purchase on our Platform, you agree to provide valid payment information. You authorize us to charge your designated payment method for the full amount of your order, including product costs, taxes, and delivery fees.

All prices on our Platform are shown in Nigerian Naira (₦) and include applicable taxes unless otherwise stated. Additional fees, such as delivery charges, will be clearly displayed before you complete your purchase.

Payment processing on our Platform is handled by our authorized payment partners. Buytopia does not store full credit card information on our servers.

We reserve the right to refuse any order placed through our Platform. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

Delivery timeframes are provided as estimates and are not guaranteed. Factors outside our control, such as weather conditions or transportation delays, may affect delivery times.

You are responsible for providing accurate delivery information. Buytopia is not responsible for deliveries that are delayed or sent to an incorrect address due to inaccurate information provided by you.

Risk of loss and title for items purchased on our Platform pass to you upon delivery of the items to the carrier. Buytopia is not responsible for lost or stolen packages after they have been delivered to the carrier.

If you receive a damaged or defective product, please contact our customer service within 24 hours of delivery to report the issue.

Our shipping partners such as GIG logistics have a 48-hour refund window for failed or canceled deliveries. Any shipping refunds are processed according to the logistics partner's policy. To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging.

Certain types of items cannot be returned, such as perishable goods, personal care items, and custom products. Please see our complete return policy for more information.

To initiate a return, please contact our customer service team at returns@buytopia360.com. You will receive instructions on how to ship the item back to the seller or to Buytopia, depending on the product.

Refunds will be issued to the original payment method once the returned item has been received and inspected. Processing times for refunds vary depending on your payment provider.

Our Platform may allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material. By providing content on our Platform, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any such content.

You are solely responsible for any content you post on our Platform. You represent and warrant that:

• You own the content you post on our Platform or have the right to post it

• Your content does not violate the privacy rights, publicity rights, copyright rights, or other rights of any person

We have the right to remove any content posted on our Platform at our sole discretion, without notice and for any reason.

Our Privacy Policy, available at www.buytopia360.com/privacy-policy, describes how we collect, use, and share your personal information. By using our Platform, you consent to our collection, use, and sharing of your information as described in our Privacy Policy.

We implement appropriate technical and organizational measures to protect your personal information. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account.

The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Buytopia, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials

• You may store files that are automatically cached by your web browser for display enhancement purposes

• If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use

You must not modify copies of any materials from the Platform or delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the Platform.

THE PLATFORM IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS, WITHOUT ANY WARRANTIES OF ANY KIND. BUYTOPIA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our Platform will be uninterrupted or error-free, that defects will be corrected, or that our Platform or the server that makes it available are free of viruses or other harmful components.

BUYTOPIA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE PLATFORM, EVEN IF BUYTOPIA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL BUYTOPIA'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID BUYTOPIA IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).

Any dispute arising from or relating to these Terms or your use of the Platform will be governed by and construed in accordance with the laws of Nigeria, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Platform shall be instituted exclusively in the courts located in Abia, Nigeria. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

You agree that any cause of action arising out of or related to the Platform must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
